01About these terms

These terms apply to your use of this website and to every purchase you make from Tranum Linen Co., Nairobi, Kenya. By placing an order, you agree to them. Please read them together with our Privacy Policy and Refund & Returns Policy.

02Products and prices

• We photograph our pieces as accurately as we can, but colours may appear slightly different on your screen. Embroidery and hand finished details may vary a little from piece to piece, which is part of their charm.
• Prices are shown in Kenya Shillings and may change from time to time. The price you pay is the price shown when you place your order.
• If we discover a pricing error on your order, we will contact you before dispatch so you can confirm or cancel at no cost.

03Placing an order

Before you pay, you can review your cart and correct any details at checkout. Once your order is placed, you will receive an email confirmation. We may decline or cancel an order if an item is out of stock, if we suspect fraud, or if there is a pricing error. If this happens, we will refund you in full.

04Payment

We accept M-Pesa and card payments, processed securely by our payment partner, IntaSend. Orders are paid in full before dispatch. We never see or store your card details or M-Pesa PIN. All prices and payments are in Kenya Shillings.

You agree to give us current, complete and accurate purchase and account information for every purchase. Please update your email address and payment details promptly, so we can complete your order and contact you. Any tax we are required to charge will be added to the price. We may change prices at any time.

You agree to pay all charges at the prices then in effect, including any delivery fee, and you authorise us to charge your chosen payment method for those amounts when you place your order. We may correct a pricing error even if we have already requested or received payment.

We may refuse any order. We may also limit or cancel quantities per person, per household or per order, including orders placed under the same account, the same payment method, or the same billing or delivery address. We may limit or prohibit orders that, in our judgement, appear to come from dealers, resellers or distributors.

05Delivery

• We deliver countrywide within Kenya. Delivery fees and estimated delivery times are shown at checkout.
• Please make sure your address and phone number are correct, so our delivery partner can reach you.
• Delivery times are estimates. If there is a delay, we will let you know as soon as possible.
• Please check your parcel on arrival and tell us within 48 hours if anything is damaged, missing or incorrect.

06Gift orders

Sending a gift? You can deliver straight to your loved one. Add the recipient's details as the delivery address and include your gift message in the order notes at checkout. We will gift pack it beautifully.

07Hospitality and bulk orders

For hotels, lodges, interior designers and corporate gifting, we offer bulk and custom orders. Prices, timelines and payment terms for these orders are agreed in writing in a separate quotation. Custom made or personalised pieces cannot be returned unless they are faulty. Contact us to start a conversation.

08Returns

09Our designs and content

All designs, photographs, text and logos on this website belong to Tranum Linen Co. Please do not copy or reuse them without our written permission. You agree to use this website lawfully and not in any way that could damage it or interfere with other shoppers.

10Our responsibility to you

We are responsible for loss you suffer that is a foreseeable result of us breaking these terms. We are not responsible for indirect loss, or for delays caused by events outside our control. Nothing in these terms affects your rights under the Consumer Protection Act, 2012 or any other law of Kenya.

11Changes and governing law

We may update these terms from time to time. The version shown when you place your order applies to that order. These terms are governed by the laws of Kenya. Tranum Linen Co. and you agree that the courts of Kenya have jurisdiction over any dispute arising from these terms, except where a dispute is referred to arbitration below.

12Prohibited activities

You may use this website only for the purpose we make it available. You may not use it for a commercial endeavour unless we have agreed to that in writing.

As a user of the website, you agree not to:

• Systematically collect data or content from the website to build a collection, database or directory without our written permission.
• Trick, defraud or mislead us or other users, including any attempt to learn account information such as passwords.
• Circumvent, disable or interfere with security features of the website.
• Disparage, tarnish or otherwise harm, in our opinion, us or the website.
• Use information from the website to harass, abuse or harm another person.
• Misuse our support channels or send false reports of abuse or misconduct.
• Use the website in a way that breaks any applicable law or regulation.
• Frame or link to the website without permission.
• Upload or transmit viruses, Trojan horses, spam or anything else that interferes with anyone's use of the website.
• Use scripts or other automated means to access the website, or place an undue burden on it.
• Harass, annoy, intimidate or threaten our staff or anyone providing the website to you.
• Bypass measures designed to prevent or restrict access to the website.
• Copy or adapt the website's software, or reverse engineer it except where the law allows.
• Use a spider, robot, scraper or similar tool, or any unauthorised script or software, to access the website.
• Use a buying agent to make purchases, or harvest user details to send unsolicited email or create accounts under false pretences.
• Use the website to compete with us, or sell or transfer your profile.

13Reviews

Where the website allows reviews or ratings, you agree that: you have first-hand experience with what you are reviewing; your review is not offensive, profane, abusive, racist or hateful; it does not discriminate on the basis of religion, race, gender, national origin, age, marital status, sexual orientation or disability; it does not refer to illegal activity; you are not affiliated with a competitor when posting a negative review; you do not draw conclusions about legality; you do not post false or misleading statements; and you do not organise a campaign for others to post reviews.

We may accept, reject or remove reviews at our discretion. We do not have to screen them. Reviews are not our views, and we are not liable for a review or for claims arising from one. By posting a review you give us a perpetual, non-exclusive, worldwide, royalty-free right to use, reproduce, modify, translate, display and distribute that review.

14Managing the website

We may, but do not have to: monitor the website for breaches of these terms; take legal action against anyone who, in our discretion, breaks the law or these terms, including reporting them to the authorities; refuse, limit or disable access to any content you post; remove files or content that are excessive in size or burdensome to our systems; and otherwise manage the website so as to protect our rights and property and keep it working properly.

15Privacy

We care about data privacy and security. By using the website, you agree to our Privacy Policy, which forms part of these terms. The website is hosted in Kenya. If you access it from another country whose data laws differ from those of Kenya, your continued use means you transfer your data to Kenya and consent to it being processed there.

16Term and termination

These terms stay in force while you use the website. Without limiting any other provision, we may, in our sole discretion and without notice or liability, refuse access to the website, including by blocking certain IP addresses, for any reason or for no reason, including a breach of these terms or of any applicable law. We may end your use, or delete your account and anything you have posted, at any time and without warning.

If we suspend or close your account, you may not register again under your own name, a false name, a borrowed name, or the name of another person. We may also take legal action, including civil, criminal and injunctive relief.

17Modifications and interruptions

We may change, modify or remove anything on the website at any time, at our discretion, without notice. We do not have to update information on the website. We may also modify or discontinue all or part of the website without notice. We are not liable to you or anyone else for any modification, price change, suspension or discontinuance.

We cannot guarantee the website will always be available. It may be interrupted for maintenance or because of hardware, software or other problems. You agree that we have no liability for any loss, damage or inconvenience caused by your inability to access the website during downtime. Nothing in these terms obliges us to maintain the website or to supply corrections, updates or releases.

18Dispute resolution

Binding arbitration

If a dispute cannot be resolved by informal negotiation, it will be finally resolved by arbitration under the UNCITRAL Arbitration Rules in force when the arbitration begins. There will be two arbitrators. The seat of the arbitration will be Nairobi, Kenya. The language will be English. The governing law will be the substantive law of Kenya.

Restrictions

Any arbitration is limited to the dispute between the parties individually. To the extent the law allows, no arbitration may be joined with another proceeding, and there is no right to arbitrate on a class basis or in a representative capacity for the public or for any other person.

Exceptions

The following are not subject to arbitration: a dispute seeking to enforce or protect intellectual property rights, or about their validity; a dispute arising from allegations of theft, piracy, invasion of privacy or unauthorised use; and a claim for injunctive relief. If this exception is found illegal or unenforceable, that part will not be arbitrated and will be decided by a court of competent jurisdiction in Kenya, and the parties agree to submit to that court.

19Corrections

Information on the website may contain typographical errors, inaccuracies or omissions, including in descriptions, pricing and availability. We may correct any error or omission and change or update the website at any time, without prior notice.

20Disclaimer

The website is provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the content of the website, or of any site linked from it, is accurate or complete. We are not liable for errors in content, personal injury or property damage, unauthorised access to our servers or to personal or financial information stored there, interruption of transmission, viruses, or errors in any content, or for loss arising from the use of anything posted or made available through the website. We do not warrant any product or service offered by a third party through the website, or any linked site, and we are not responsible for monitoring dealings between you and a third party. As with any purchase, use your own judgement and take care where appropriate.

21Limitation of liability

To the fullest extent permitted by law, we and our directors, employees and agents will not be liable for any indirect, consequential, incidental, special or punitive damages, including lost profit, lost revenue or loss of data, arising from your use of the website, even if we have been advised of the possibility. Our liability to you for any cause, whatever the form of the action, will at all times be limited to the amount you paid us during the three months before the cause of action arose, if you paid anything. The laws of Kenya may not allow some of these limits. If they do not, some or all of the limits above may not apply to you, and you may have additional rights. Nothing in these terms removes rights you have under the Consumer Protection Act, 2012.

22Indemnity

You agree to defend and indemnify Tranum Linen Co. and our officers, agents, partners and employees against any loss, damage, liability, claim or demand, including reasonable legal fees, made by a third party because of your use of the website, your breach of these terms, your breach of your representations, your violation of a third party's rights, including intellectual property rights, or a harmful act toward another user. We may, at your expense, assume the exclusive defence and control of any matter you are required to indemnify us for, and you agree to cooperate with that defence. We will use reasonable efforts to tell you of any such claim once we know of it.

23Your data on the website

We keep certain data you send to the website so we can manage how it performs, and data about how you use it. We make routine backups, but you are responsible for data you transmit or for activity you undertake on the website. We are not liable for any loss or corruption of that data, and you waive any claim against us arising from it.

24Electronic communications

Visiting the website, emailing us and completing online forms are electronic communications. You consent to receive electronic communications, and you agree that agreements, notices, disclosures and other communications we provide electronically, by email and on the website, satisfy any legal requirement that they be in writing. You agree to the use of electronic signatures, contracts, orders and records, and to electronic delivery of notices and records of transactions. You waive any right or requirement under any law that calls for an original signature, or for delivery or retention of non-electronic records, or for payments or the granting of credits by any means other than electronic means.

25Miscellaneous

These terms and any policies posted on the website are the entire agreement between you and Tranum Linen Co. If we do not enforce a right, that is not a waiver of it. We may assign our rights and obligations at any time. We are not liable for any loss, delay or failure caused by something outside our reasonable control. If any part of these terms is found unlawful or unenforceable, the rest stays in force. These terms do not create a partnership, employment or agency. They will not be read against us merely because we drafted them.
